Huku Kwetu Stays (“we”, “us”, “our”) acts solely as an agent for all bookings made on your behalf. We accept no liability for any contracts you enter into, services or arrangements you purchase (“arrangements”), or the acts or omissions of any supplier(s) or other parties involved in your arrangements.
For all arrangements, your contract will be with the supplier / principal of the chosen ApartHotel (“Supplier/Principal”). When making your booking, we will arrange for you to enter into a contract with the applicable supplier. Your booking is subject to these agency terms and conditions and the specific booking conditions of the relevant supplier, which you are advised to read carefully before booking. The Supplier/Principal’s terms and conditions may limit or exclude their liability to you. Copies of applicable conditions are available upon request.
You can make a booking request by phone, fax, email, or using the online booking form on our website. To make a valid booking request, you must provide the following information for yourself and all members of your party:
We will try to acknowledge your request within 24 hours and contact the Supplier/Principal to confirm availability.
Unless you have a pre-existing credit agreement, full payment for your chosen ApartHotel, as required by the Supplier/Principal, is necessary to confirm your booking. Your booking is confirmed, and a contract between you and the Supplier/Principal exists, when we send you a confirmation on their behalf. Please check your confirmation carefully and report any errors or incomplete information immediately. Ensure all names match the relevant passport exactly. As an agent, we are not responsible for documentation errors unless we made the mistake.
Except where otherwise advised, all monies paid to us for arrangements will be held on behalf of the Supplier/Principal(s) and forwarded according to our agreement with them.
Huku Kwetu Stays acts as your agent when making bookings for ApartHotels as part of our Booking Services. We help you arrange and pay for Serviced Accommodation. In this role, you appoint Huku Kwetu Stays to act on your behalf and authorize us to:
We do not directly supply the ApartHotels. Instead, we act as your agent and follow your instructions. When we book an ApartHotel at your request, we will establish a separate contract between you and the Third-Party Supplier, who will be identified on your Booking Confirmation. Your booking will be subject to the Third-Party Supplier’s terms and conditions, in addition to our agreement with you.
This agreement governs the contractual relationship between you and Huku Kwetu Stays for the Booking Services we provide. Our terms and conditions apply and exclude any other terms you attempt to impose, incorporate, or imply through custom, practice, or course of dealing.
For each booking, the Booking Contract for the ApartHotel will be established between you and the Third-Party Supplier, according to their terms and conditions. Huku Kwetu Stays is not a party to the Booking Contract and has no responsibility for the provision or condition of the ApartHotel.
Both parties agree that this agreement qualifies as a “general agreement” for business travel exemption within the Package Travel and Linked Serviced Accommodation Regulations 2018 (PTR) and the Civil Aviation (Air Travel Organisers’ Licensing) Regulations 2012 (ATOL Regulations). Therefore, the ApartHotels sourced and booked by Huku Kwetu Stays as part of our Booking Services are exempt from the scope of the PTR and ATOL Regulations. You and/or your personnel are not afforded any rights provided by the PTR or ATOL Regulations.
To request our Booking Services for an ApartHotel, please contact us through our website, by phone, or by email. When making your request, please provide as much information as possible to assist us in finding the perfect ApartHotel for you and making your booking. This information may include your desired location, dates, number of guests, and any special requirements.
If your desired ApartHotel is available, we will submit a booking request to the relevant Third-Party Supplier on your behalf. Please note that all ApartHotels are subject to availability.
Once the Third-Party Supplier accepts your booking request, they will issue a Booking Confirmation. Upon issuance of the Booking Confirmation, your booking is confirmed and a Booking Contract between you and the Third-Party Supplier is established. The Booking Confirmation represents a legally binding obligation for you to pay the associated charges.
It is your responsibility to carefully review the Booking Confirmation. This includes verifying the dates, times, location of the ApartHotel, the cancellation policy, and any specific requirements you may have requested. If any information is incorrect, please notify us immediately. You are responsible for ensuring the completeness and accuracy of your booking and Booking Confirmation.
You are responsible for paying all charges associated with each ApartHotel booking in full. If full payment is not received by the due date, we reserve the right to notify the Third-Party Supplier. The Third-Party Supplier may then refuse to confirm your booking or, if confirmed, cancel your booking and charge the cancellation fees outlined in their terms and conditions.
Invoices must be paid within 30 days of receipt. Unless otherwise notified in writing, you are obligated to pay all invoices submitted by Huku Kwetu Stays upon receipt, to a designated bank account.
You and/or your guests are responsible for any additional charges or “Extras” incurred during your stay, as determined by the Third-Party Supplier. These Extras are typically due before your departure date. If the Third-Party Supplier charges Huku Kwetu Stays for any Extras on your behalf, you agree to reimburse us for these charges and settle any invoice we may issue.
You are required to pay all amounts due to Huku Kwetu Stays in full without any deductions, counterclaims, offsets, or withholding (except for any legally required deductions or withholding).
If Value Added Tax (VAT) applies to some or all of your booking, you are responsible for paying us the additional VAT amount at the applicable rate, along with the original charges.
Huku Kwetu Stays receives commission payments from Third-Party Suppliers for booking placements. The availability (or absence) of this commission does not influence our decision to choose a particular Third-Party Supplier.
We reserve the right to change advertised prices at any time and to correct errors in both advertised and confirmed prices. It is your responsibility to confirm the price of your chosen arrangements at the time of booking.
Unless otherwise stated, all ApartHotels and services are quoted exclusive of VAT (UK only) or local taxes (outside UK), and prices are advertised per ApartHotel, per night.
We strongly recommend travel insurance for all members of your party. Some Supplier/Principals may require it. You are responsible for ensuring your chosen insurance is adequate and appropriate for your needs. Please review your policy details carefully and bring them with you on your trip.
Please inform us of any special requests at the time of booking. We will pass them on to the Supplier/Principal, but we cannot guarantee they will be met and have no liability if they are not.
Any cancellation or amendment request must be sent to us in writing by email and will take effect upon receipt. Written confirmation of any changes is required before travel. While we will try to assist, we cannot guarantee such requests will be accepted.
Amendments and cancellations can only be made according to the Supplier/Principal’s terms and conditions, which may allow for charges up to 100% of the arrangement cost, typically increasing closer to departure.
We will inform you as soon as possible if the Supplier/Principal needs to make significant changes to your arrangements or cancel them. We will also liaise with them regarding any alternative arrangements offered, but we will have no further liability to you.
Your contract is with the Supplier/Principal, and their booking conditions apply. As an agent, we accept no responsibility for the actual provision of the arrangements. Our responsibilities are limited to making the booking according to your instructions. We accept no responsibility for any information about the arrangements that we pass on to you in good faith. However, in the event that we are found liable, our maximum liability is limited to twice the commission earned on your booking (or a proportional amount if not everyone on the booking is affected). This does not exclude or limit our liability for death or personal injury arising from our negligence or that of our employees acting within the scope of their employment.
Because your contract for the ApartHotel stay is with Huku Kwetu Stay, any concerns or queries should be addressed to us directly. If you encounter a problem during your stay, report it to Huku Kwetu Stay immediately. Failure to follow this procedure may reduce or eliminate your compensation, as Huku Kwetu Stay will have less opportunity to investigate and rectify the issue.
If you wish to complain after your ApartHotel stay has ended, you should write to the Huku Kwetu Stay. Huku Kwetu Stays can assist you in contacting the Supplier/Principal to resolve any complaints. Please contact us for more information.

These Terms and Conditions are governed by English law. We both agree that any dispute arising from or related to these Terms and Conditions will be dealt with by the Courts of England and Wales only. However, if you live in Scotland or Northern Ireland, you may choose the law and jurisdiction of those territories.
